Alert: Upcoming Changes to Alabama Notary Laws

 

You may not be aware, but changes to Alabama's notary statutes will take effect on September 1, 2023. These changes affect many aspects of notary public law, including the commissioning and application process.

The new law will increase the bond amount from $25,000 to $50,000, and the cost of the notary bond will increase as well. Remember, the notary bond is designed to protect the public against financial loss resulting from a notary's misconduct. For personal protection, a notary must purchase E&O insurance.

To help ensure all notaries are knowledgeable of all matters relevant to the appointment, authority, duties, and legal and ethical responsibilities of a notary public, all applicants will be required to complete the notary public training course administered by the Alabama Probate Judges Association prior to being commissioned.

Additionally, the law introduces an additional $10 application fee, increases the notary commission issuance fee (County fee), and expands the grounds on which a notary public commission application could be rejected.

To avoid the hassle of a potentially more complicated process and additional fees, we encourage you to act now and complete the application process with the Judge of Probate's office before the new law takes effect, September 1st.
