What to Do When the Notarial Certificate Is Missing?

It is common for document signers to be unsure about the type of notarization they need. If the document does not have the appropriate notarial language (notary certificate) to specify which notarial act to be performed, the document signer must choose. But how can they decide if they don't understand?
Although you are unable to select the notarial act on behalf of the signer, there are certain steps you may take to assist them in selecting the appropriate one. Once you realize that the notarial certificate is missing from the document, inform the signer and explain why it is necessary and that you must add it in order to continue. Ask if the signer knows which notarial act they want you to perform. If the signer is not familiar with the various acts, you may provide examples of the different notarial certificates and explain the difference between these notarial acts. However, you should be careful not to provide any advice unless you are an attorney licensed to practice law in your state. If the signer still has difficulties, consider suggesting that they speak with the party who requested the notarization to gain guidance or consult with an attorney for legal advice on how to execute the document properly.
Once the signer selects a notarial act, you may add the appropriate notary certificate to the document. If the signer does not select a notarial act, you must decline to proceed. Either way, be sure to document what happened in your record book.
By taking the time to explain the types of notarial acts and why the notarial certificate is necessary, you can help the signer understand and make an informed decision regarding their document.
Pro Tip: Make sure to have jurat and acknowledgment stamps and/or loose paper notarial certificates on hand so that you are better prepared for situations such as this.
