Can Texas Notaries Accept an Expired ID?

While some states allow expired IDs, Texas law is much stricter.
Texas’ Rule on Expired IDs
Texas notaries may only accept current identification or other document issued by the federal government or any state government that includes both a photograph and signature of the individual. For residential real estate transactions involving a deed or other instrument, a current passport issued by a foreign country may also be used. However, expired documents are never valid, regardless of the transaction type.
Credible Witnesses in Texas
Texas does permit notaries to identify a person through the use of a credible witness. A credible witness is an individual who personally knows the signer and can swear under oath to their identity. This method is particularly useful when the signer does not have acceptable identification, such as a driver’s license or passport, but must still complete a notarization. When relying on a credible witness, notaries must follow Texas’s requirements and procedures.
